Welcome to Wordums! These Terms and Conditions ("Terms") govern your use of our mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Use of the App
Eligibility: You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
Account Registration: To access certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
User Responsibilities: You are responsible for your use of the App and for any content you post. You agree not to use the App in any way that is unlawful, harmful, or in violation of these Terms.
3. Intellectual Property
Ownership: The App and its original content, features, and functionality are and will remain the exclusive property of Dead Simple Games LLC and its licensors.
Restrictions: You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the App.
4. User Content
Responsibility: You are solely responsible for any content you post, upload, or otherwise make available through the App.
License: By posting content on the App, you grant us a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App and our business.
5. Prohibited Activities
You agree not to:
Use the App for any illegal or unauthorized purpose.
Attempt to gain unauthorized access to the App or its related systems or networks.
Engage in any activity that interferes with or disrupts the functioning of the App.
Use the App to transmit any viruses, worms, or other malicious code.
Use any automated system, including but not limited to robots, spiders, or offline readers, to access the App in a manner that sends more request messages to the servers than a human can reasonably produce in the same period by using a conventional online web browser.
6. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
7. Disclaimers and Limitation of Liability
Disclaimer of Warranties: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability: In no event shall Dead Simple Games LLC its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (vi) any other matter relating to the App.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Illinois, without regard to its conflict of law provisions.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
